Membership Terms & Conditions:

In consideration of being allowed to participate in the activities and programs of Diamond Fitness (Southern) Ltd and to use its facilities, equipment and machinery in addition to the payment of any fee or charge and subject only to the statutory rights and implied warranties which cannot be excluded, I do hereby waive, release and forever discharge Diamond Fitness (Southern) Ltd and their officers, affiliates, subsidiaries, agents, employees, representatives, executors and all others from any and all responsibilities or liabilities from injuries or damages arising out of or connected with my attendance at Diamond Fitness (Southern) Ltd, and any premises owned, operated, controlled and or leased by Diamond Health & Fitness representatives with the exception of any liability for death or personal injury arising from the negligence of Diamond Fitness (Southern) Ltd representatives, my participation in all activities, my use of equipment of machinery, or any act of omission.

I understand and am aware that strength training, flexibility and aerobic exercise, including the use of equipment, are a potentially hazardous activity. I also understand that fitness activities involve a risk of injury and even death, and that I am voluntarily participating in these activities and using equipment and machinery with knowledge of the dangers involved. Subject only to the stator rights and implied warranties which cannot be excluded, I hereby agree to expressly assume and accept any and all risk of injury or death in respect to myself and caused directly by me or as a result of my conduct, omissions or negligence to others. I hereby further agree to expressly assume all responsibility for any injury or death caused directly or indirectly through my conduct, omissions or negligence to any third person (including Diamond Fitness (Southern) Ltd representatives) though my attendance Diamond Fitness (Southern) Ltd and any premises owned operated, controlled and or leased by Diamond representatives.

I do hereby declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity, or other illness that would prevent my participating or use of equipment at the Diamond Fitness (Southern) Ltd facility. I do hereby acknowledge that I have been informed of the need for a medical practitioner’s approval in my participation in an exercise fitness activity or in the use of exercise equipment and machinery. I also acknowledge that it has been recommended that I have a yearly or more frequent physical examination and consultation with my physician as to physical activity, exercise and use of exercise and training equipment so that I might have his/her recommendations concerning these fitness activities and equipment use. I acknowledge that I have either had a physical examination and been given my medical practitioners permission to participate, or that I have decided to participate in activities and use of equipment and machinery without the approval of my physician and do herby assume, subject only to the stator rights and implied warranties which cannot be excluded, all responsibility for my participation, activities and utilisation of equipment and machinery in my activities. 

I understand that if I wish to cancel my membership with Diamond Fitness (Southern) Ltd, I must do so by providing 60 DAYS WRITTEN NOTICE (in the form of a letter) from my next payment date. I understand that two payments will then be processed in accordance to my notice period; therefore my final payment will be 2 x £35.00 for an adult membership or 2 x £20.00 for an u18 membership. These payments will be debited on my assigned monthly payment date. We will always call you to confirm safe receipt of your cancellation letter and advise you of your final payment dates.

If you fail to fulfil this request any outstanding debt will be passed onto a debt collection agency which could result in further fees being applied and credit reference agencies being notified of the defaulted balance.

By taking out a membership with Diamond Fitness (Southern) LTD, you do hereby agree to the terms stated above.
